These Terms of Service govern access to and use of the Marie Thüler website, as well as the purchase of artworks and related services offered through it.
By visiting this website, placing an order, or otherwise using the services available through it, you agree to these Terms of Service, together with the Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on the site.
1. About the studio
This website is operated by Marie Thüler ART.
Throughout these Terms, “we,” “us,” and “our” refer to Marie Thüler ART. “You” and “your” refer to the visitor, client, or user of the website.
2. Use of the website
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others, restrict their use of the website, or interfere with the proper operation of the site.

3. Artworks and product information
The studio makes every effort to present artworks, descriptions, dimensions, and details as faithfully as possible.
Because artworks are viewed on different screens and devices, slight variations in color, texture, or visual perception may occur between the digital image and the artwork in person. Such variations do not in themselves constitute a defect.
All artworks remain subject to availability. In the case of a rare inventory error, the studio reserves the right to cancel an order and issue a refund where a work is no longer available.
4. Prices and payment
All prices are shown in the currency displayed on the website at the time of purchase.
The studio reserves the right to update prices at any time, provided that the price confirmed at checkout will be the price applicable to your order.
Payment must be made through the payment methods made available at checkout. Orders will only be processed once payment has been successfully authorized.
5. Orders
Placing an order constitutes an offer to purchase the selected artwork or service.
The studio reserves the right to accept or decline an order where reasonably necessary, including in cases of pricing errors, suspected fraud, lack of availability, or inability to fulfill the order.
If an order cannot be accepted after payment has been made, the amount paid will be refunded.
6. Shipping and delivery
Shipping arrangements are governed by the applicable Shipping Policy.
Delivery times are provided for guidance only and are not guaranteed unless expressly agreed otherwise in writing. The studio is not liable for delays caused by carriers, customs procedures, force majeure, or events beyond reasonable control.
Risk in the artwork passes to you upon delivery, unless applicable law requires otherwise.
7. Returns and refunds
Returns and refunds are governed by the Refund Policy published on the website.
You are encouraged to review that policy carefully before placing an order.
8. Commissions and custom work
Where the studio accepts a commission or other bespoke request, the specific terms of that project may be agreed separately in writing.
Unless otherwise agreed, commissioned and personalized works are final and non-returnable once work has begun or the piece has been completed in accordance with the agreed brief.
9. Intellectual property
All content on this website, including but not limited to text, artwork images, photographs, branding elements, logos, layout, and visual presentation, is protected by intellectual property laws.
No content from this website may be copied, reproduced, distributed, published, adapted, or used for commercial purposes without prior written permission from the studio.
The purchase of an original artwork does not transfer copyright or reproduction rights unless expressly agreed in writing.

This website may include links to third-party websites or rely on third-party platforms and providers, including Shopify, payment services, and shipping partners.
The studio is not responsible for the content, availability, or policies of third-party websites or services not operated directly by the studio.
11. Disclaimer
The website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law.
While every effort is made to keep the information accurate and current, the studio does not guarantee that the website will always be uninterrupted, error-free, or entirely free from technical issues.
Nothing in these Terms excludes any rights that cannot be excluded under applicable law.

To the fullest extent permitted by law, Marie Thüler ART shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the website or purchase of products through it.
